NOTABLE TRANSACTIONS: Waukee development enmeshed in several legal proceedings changes ownership

Fourteen lots in a Waukee development mired in legal proceedings have been acquired by a West Des Moines investment firm for $1.2 million, Dallas County real estate transaction records show.

Brandon’s Reserve, located on 13 acres west of Warrior Lane at Park Road, was originally developed by M&R Holdings LLC, whose owners are David and Jody Walters of Urbandale. In January 2017, the Environmental Protection Agency announced it had fined M&R Holdings $8,350 for discharging pollutants into a Waukee’s Sugar Creek.

In December 2016, Alliance Construction Group LLC filed a mechanic’s lien against M&R Holdings and other entities for failure to be paid more than $242,140 for work completed in the development, records filed in Dallas County District Court show. Two years later, Alliance filed a petition to force the sale of the development’s remaining 14 lots to satisfy the debt owed Alliance.

Asymmetria Investors LLC filed a counter-petition requesting that property be sold and proceeds be provided to the West Des Moines firm because it provided the mortgage for development, court records show. The court, after Alliance filed a statement of no resistance to Asymmertria’s request, found in favor of the West Des Moines firm.

Asymmertria acquired the 14 lots on Jan. 8, records show. Brandon’s Reserve, located west of Waukee’s Centennial Park, includes a pond with fountain and two cul-de-sacs.

In other transactions:

A Boone couple paid Perry Business Plaza LLC $1.2 million on Feb. 11 for a 42,364-square-foot retail strip center located at 401 First Ave., Perry, real estate records show. Located in the strip center, built in 1976, are Orscheln Farm and Home, a restaurant, a fitness center and a chiropractor. The center was bought by the Eric and Carol Ziel Revocable Trust. The center in 2019 was valued at $952,460, records show.

The Five Holdings Inc. paid Kettlestone Heights LLC $3.5 million on Feb. 14 for a townhouse development at Southeast Westown Parkway and Southeast Parkview Crossing Drive in Waukee, records show. Robert Caluzzi, a real estate broker who lives in Waukee, is listed as Five Holdings’ president, according to Iowa secretary of state records. The two-story townhouses were built as six-plexes and include three bedrooms. Five Holdings bought 18 townhouses, records show.

Michael and Susan Downing paid Jerry Bussanmas LLC $1.1 million on Feb. 20 for property at 17543 Berkshire Parkway in Clive, records show. The 1 1/2-story house built in 2019 includes 3,855 square feet of living space and a swimming pool.

 
 
 

Kum & Go LLC paid the real estate arm of Nebraska Furniture Mart $1.85 million on Feb. 17 for property at 15590 Hickman Road in Clive, records show. The site originally was part of the former Dahl’s Food Stores, which filed for Chapter 11 bankruptcy in November 2014. Nebraska Furniture Mart bought the property and renovated the former grocery store into an outlet for the sale of appliances and flooring. The parking lot was larger than Nebraska Furniture Market needed. Kum & Go bought the excess 2.6 acres, valued at $912,300 in 2019. According to a site plan filed with the city of Clive, Kum & Go plans to build a 5,620-square-foot convenience store that will include the company’s Go Fresh Market and 12 fueling stations.

Landlock Properties LLC paid the Richard S. Ingham Revocable Trust $1.6 million on Feb. 5 for 86 acres in the 3000 block of Southeast Army Post Road in West Des Moines, Polk County real estate transactions show. Landlock Properties was organized by Frederick Ingham, president of Hubbell Realty Co., secretary of state records show.

BMP Hotel Management Inc. of Ankeny paid Paragon Best LLC $1.27 million on Feb. 12 for property at 8901 Plum Drive, records show. The managing partner of Paragon Best is Mark Rupprecht of R&R Realty Co. BMP Hotel Management was incorporated by Arvind Patel. The Plum Drive property is in a hotel-heavy area south of Interstate Highway 80. Hampton Inn & Suites, Holiday Inn Express, Microtel Inn and Suites and Fairfield Inn and Suites are located in the area, as are several restaurants.

Hy-Vee Inc. paid QuikTrip Corp. nearly $1.4 million on Feb. 13 for property at 7200 Hickman Road in Windsor Heights and at 3809 100th St. in Urbandale, records show. Earlier this month, QuikTrip announced it was closing four of its locations. A couple of days later, Hy-Vee announced it had acquired the QuikTrip stores. Hy-Vee said it planned to reopen the convenience stores on March 20 under the Hy-Vee Fast & Fresh Express brand. The Windsor Heights QuikTrip, built on 1.3 acres in 2004, was valued at $1.2 million in 2019, records show. The Urbandale property was valued at $206,000. Records of the other transactions between Hy-Vee and QuikTrip have not yet been recorded.

Druppel Investments LLC paid GNS Investments LLC $1.2 million on Feb. 14 for residential properties at 800 S.E. 10th St and 917 Maury St., records show. The Maury Street property includes a split-foyer-style residence built in 1979. The property is valued at $117,100, records show. The Southeast 10th Street property includes a split-foyer duplex built in 1979. The properties are immediately south of the Market District, an industrial area that city of Des Moines officials want redeveloped into a pedestrian-oriented neighborhood. Druppel Investments is operated by Joe Druppel of Urbandale.

A Florida-based group operating as HCII 250 SW Brookside Drive LLC paid Kim Rueter Co. $4.82 million on Feb. 6 for property at 250 S.W. Brookside Drive in Grimes, records show. The property includes a 14,568-square-foot medical office built in 2017 and occupied by a Mercy Clinic. The property in 2019 was valued at $2.8 million, records show.

A Chicago-based investment group operating as Jam Investments of Altoona LLC paid McConnell Real Estate Development LC of Johnston $1.2 million on Feb. 19 for property at 6230 S.E. 14th St. in Des Moines, records show. The property, which includes a 2,584-square-foot restaurant occupied by Popeye’s Louisiana Kitchen, was valued at $778,700 in 2019, records show.

Bennett Real Estate Co. LLC paid DRA Properties LC $2.2 million on Feb. 20 for property at 1510 S.W. Vintage Parkway in Ankeny, records show. The property includes a newly constructed 4,686-square-foot restaurant that will be occupied by Smokey Row, records show.

A&A Realty Group LLC of Urbandale paid Dale and Mary Beth Day $1.8 million on Feb. 20 for property at 12408 Meredith Drive in Grimes, records show. The property includes 34.6 acres, a single-family house built in 1997 and a large shed. The property in 2019 was valued at $364,830, records show.
