Attorney General Tom Miller filed an application today asking a Polk County judge to enforce consumer fraud subpoenas against a Michigan company that had previously agreed to change its marketing practices. In August 2010, Miller filed a consumer fraud lawsuit against Associated Community Services Inc. (ACS) of Southfield, Mich., which accused the company of violating Iowa’s Consumer Fraud Act. ACS, which solicited Iowans on behalf of “Vietnam Veterans of Iowa Inc.,” had settled the lawsuit by agreeing to a consent judgment in which it said it would change its marketing practices and paying $35,000 to the state’s consumer fraud enforcement fund. Miller is now asking a judge to require ACS to fully comply with two subpoenas filed by his office in June and August.
