Bank of America sues developer for $9.6 million

Bank of America Corp. is seeking $9.6 million from a development company connected to Ankeny businessman Dennis Albaugh. The lender says it is owed that amount on an $11.5 million loan it made in 2008 to SanCaro Development Inc., a real estate development company that lists Albaugh as a director in records on file with the Florida secretary of state. Albaugh and his wife, Susan, signed personal guarantees for the full amount of the loan, as did the Dennis R. Albaugh Trust, according to a lawsuit filed in U.S. District Court in Des Moines. Business partner Dale Glon signed a personal guarantee for half of the loan, which also was secured by development properties and two residences on Marco Island, Fla. Bank of America said SanCaro missed a $200,000 principal payment on June 30. The payment was required as part of an amendment earlier this year to the loan document. Craig Woodward, SanCaro’s registered agent, said he was not aware that Bank of America had filed the lawsuit.
